The Ceramics Studio, Ettington – Course Booking Terms and Conditions

Please ensure you have read and understood these Terms and Conditions before the end of your 7 day cooling off period. By passing this period you are deemed to have read, understood and accepted them.

CONTRACT OF SALE

Completion of the booking process and acceptance of our terms and conditions forms your contract with Leyla Folwell Ceramics Ltd. trading as The Ceramics Studio.

PAYMENT

Payment of the full course fees must be made in advance and should be made at the time of placing a booking. It is not possible to attend a course unless payment has been received.

Currently we accept payment by BACS, Paypal or cheque. For some clients, for example local authorities and schools, we can issue an invoice and payment may be made by BACS or cheque. Invoices must be settled within 7 days of the invoice date or in advance of the training course, whichever is sooner.

VOUCHERS

A voucher is valid for 12 months from the date on it and cannot be honoured after this time. All cancellation conditions apply to voucher holders.

CANCELLATION

Cancellations must be made in writing by post or email to peoplespottery@gmail.com.

Cancellations will be subject to the following fees:

  • Cancellations within 14 days of the start date will be charged the full course fee.

  • Cancellations within 15-28 days of the start date will be charged 50% of the course fee.

  • Cancellations more than 28 days before the start date will be charged 20% of the course fee.

If the participant fails to attend the course the full course fees are payable.

Under the Consumer Protection (Distance Selling) Regulations 2000 (“Distance Selling Regulations”), you may cancel your purchase of a course within a period of 7 working days beginning on the day after we send your booking confirmation. However, there is no right of cancellation where the course begins within this seven day period.

DELEGATE SUBSTITUTION

A substitute delegate may be named at any time before the course at no additional cost.

TRANSFER

Requests to transfer to an alternative course or date must be made in writing by post or email. Transfers may be made up to 28 days before the course start date and will incur no additional fee. However, transfers are subject to availability and The Ceramics Studio is not obliged to ensure suitable alternatives are available. A booking can only be transferred on one occasion. Requests for subsequent transfers will be treated as cancellations.

COURSE CONTENT

The Ceramics Studio reserves the right to change the content, timing, date, venue or instructor of the course in order to provide a high quality service or where it is necessary for reasons beyond our control. The Studio reserves the right to cancel a course up to and including the date of the course if insufficient bookings have been received and will strive to give as much notice of this as possible. Individuals booked onto a cancelled course will be given the option of a full refund or of rescheduling to a future course date. The Studio will not be liable for any losses or expenses arising from amendments to the course or cancellations. 

LATE ATTENDANCE

It is to the discretion of the tutor to not accept a late arrival to a course if it is potentially detrimental to fellow students. This will be treated as a late cancellation.

INTELLECTUAL PROPERTY

Course materials are supplied only for your personal use. The Studio remains the owner of all intellectual property in course materials. No part of the materials may be copied or reproduced without our permission.

DISCLAIMER AND SELLING

Please note that all materials have been selected as they suit a range of pottery techniques and are for amateur use.  Materials are not tested and are not guaranteed for commercial use. Fired pottery is for occasional or decorative use.  Classes are for leisure and no work made in these sessions should be sold online or in any retail situation.

HEALTH AND SAFETY

The Studio takes a diligent approach to health and safety for the sake of all staff and users. Students are agreeing to read and abide by the guidelines of our Health & Safety policy.  Repeated failure to do so will result in immediate termination of course without refund.

TECHNICAL ISSUES AND BREAKAGES

Experienced and trained staff only will handle and fire your ceramic work.  However, by the nature of ceramics there is always a risk of technical failure for which we cannot be held responsible.

PROLIFIC MAKERS

Ceramics is an expensive process and we try hard to keep the costs down. We price the classes based on an estimated output. Occasionally we will get someone who is a prolific maker, we do not want to cap people’s creativity so we will ask you to pay a cost price for any work you chose to fire over the set amount laid out by your tutor for your particular course or session.

COLLECTION OF WORKS

We recommend you collect your finished work as soon as possible after your course to help keep our storage area clear therefore avoiding damage.  If finished ceramic work is not collected within 3 months of the end of the course we will sadly have to dispose of it. If you attend a course from further afield we can post your wares to you for just the basic postage cost.

Memberships

Memberships are a year's agreement and fees will only be refunded due to critical illness.  We reserve the right to transfer or cease a membership. We consider it more appropriate for the student or advantageous to the group as a whole.

Conduct and behaviour

Kindness and respect are part of the company's core values. Any offensive, aggressive, or disrespectful behaviour will result in an immediate termination of membership and cancellations of any future bookings.

DATA PROTECTION

Any personal information you give to us will be processed in accordance with the Data Protection Act 2018. We will use the information to process your booking.  We will not share your contact details and any personal data you provide may be held securely on computer files.

APPLICABLE LAW AND JURISDICTION

These terms and conditions are governed by and construed in accordance with English law and any dispute arising out of or in connection with them shall be settled by the English courts.
